1. Introduction

Welcome to DirectHire SA (“we”, “us”, “our”). By accessing or using this website and its services (“the Platform”), you agree to these Terms & Conditions. The Platform operates as an online directory intended to help connect independent contractors (“Workers”) with members of the public or businesses seeking services (“Clients”).

2. We Are A Directory Only

DirectHire SA is not an employer, labour broker, recruitment agency, or contracting company. We do not employ, manage, supervise, or control any Worker listed on the Platform.

• We do not screen, vet, certify, guarantee, or endorse Workers, Clients, profiles, reviews, qualifications, or any information submitted to the Platform.
• We do not guarantee the quality, safety, legality, timing, or outcome of any work performed.
• We are not a party to any agreement, quotation, arrangement, or contract between a Worker and a Client.
• All quotes, payments, deliverables, site access, and disputes are strictly between the Worker and the Client.

3. Limitation of Liability

To the fullest extent permitted by South African law, DirectHire SA will not be liable for any direct or indirect damages, losses, injury, claims, disputes, or costs arising from:

• your use of the Platform,
• reliance on any listing or information on the Platform, or
• any engagement, communication, payment, or work performed between a Worker and a Client.

Use of the Platform is at your own risk. Where applicable, nothing in these Terms limits any rights you may have under the Consumer Protection Act (CPA) that cannot legally be excluded.

4. For Workers (Profile Creation)

By creating a profile, you acknowledge and agree that the information you submit (including your name, contact number, location/area, and trade/services) may be publicly visible and accessible.

You confirm that:

• the information you provide is accurate and not misleading,
• you are an independent contractor and not representing DirectHire SA, and
• you have the legal right to work in South Africa (where applicable).

You are responsible for keeping your profile details up to date.

5. Premium Services (Gold Status)

Payments made for “Featured”, “Gold Status”, or similar promotional options are for advertising visibility only. DirectHire SA does not guarantee any specific number of leads, calls, messages, appointments, or jobs as a result of premium placement.

Unless required by law, premium fees are non-refundable once the promotion has been activated.

6. User Conduct

You agree not to use the Platform to post, transmit, or promote: illegal content, scams, harassment, hate speech, explicit adult services, weapons-related content, illegal substances, or any misleading or fraudulent listings.

We reserve the right, at our sole discretion, to remove content, suspend users, or report unlawful activity to relevant authorities.

7. Privacy Policy (POPIA Compliance)

DirectHire SA is committed to protecting your personal information in accordance with the Protection of Personal Information Act (POPIA).

• Consent to Display: By registering a profile, you explicitly consent to your Name, Trade, Contact Number, and Location being made publicly available on this directory for the purpose of receiving work enquiries.
• Data Usage: Your data is used solely for the operation of this Platform. We do not sell your contact details to third-party marketing lists.
• Right to Delete: You have the right to access, update, or permanently delete your personal information at any time via the "Edit Profile" feature. Once deleted, your data is removed from our live registry.
